Conservation and Environmental


  • Administrative Review - These are the simplest filings with the local Conservation Commissions.  These are generally completed for minor projects.
  • Request for Determination of Applicability - These applications are the next level for projects within Conservation Jurisdiction.  Applicable projects include those that will have minimal negative effect on the interests of the Commission and the applicable regulations.
  • Notice of Intent - These applications are the most common for projects within Conservation Jurisdiction.
  • Notice of Intent with Local Variance - When work is proposed within locally determined "No-Disturb Zone" (typically within 50' of the resource and within the resource area) a Notice of Intent with a Local Variance is needed.
  • MEPA - ENF - A Massachusetts Environmental Policy Agency Environmental Notification Form is an overwhelming mass of paperwork and bureaucracy.  We generally advise clients to avoid projects that trigger this level of review, but when there is no other option, we will prepare the necessary documentation and file it according to the defined requirements.
  • DEP Appeals - In the unfortunate circumstance that a project cannot be approved locally and an Appeal is sought, we can offer expertise in the local and State regulations and statutes along with the project  to assist an Attorney in the process of appealing to the Department of Environmental Protection and the Courts as needed.
