Answer: The simple answer is no. The properties combined contain over 180k S.F. and may have suitable frontage for a panhandle plus three 60k S.F. lots however almost 1/3 of the combined land is within the Six Ponds Zone B that requires 100k SF of area. The complex answer is: Can an attorney find a way? Variance? Given the amount of protest regarding the nearby Wise / O’Connell ANR development and the Marsh / O’Connell development abutter / neighborhood opposition can be expected. The land behind this property is held by the Harwich Conservation Trust and therefore is not available for addition to the subject property. The RPM Carpets facility contains more than the requisite area however their facility designs appear to cover around 25% of their total lot area.
Section 325-97 Dimensional Regulations:
Lots in more than one district. Where the district boundary line between Zone A and Zone B divides a lot in existence at the time such line is adopted, each portion of the lot shall comply with the area requirements for the applicable zoning district.
Developed lots. Structures on preexisting, nonconforming lots may be added to or extended, and accessory structures exceeding 100 square feet constructed, on the provision that the addition, extension, or accessory structure exceeding 100 square feet meets the following criteria:
(1) The addition, extension, or accessory structure exceeding 100 square feet is set back no less than 25 feet from any street and 20 feet from the side and rear lot lines; and
(2) Maximum lot coverage does not exceed 25%.
